The terms governing access to and use of the JobKred website. JobKred products are governed by their own Service Agreements.

1.1 These terms of use ("Terms") govern access to and use of the website at www.jobkred.com, including its subdomains and any content made available on them (the "Website").
1.2 The Website is owned and operated by JobKred Pte. Ltd., a company incorporated in Singapore with registration number (UEN) 201433843C, of 60 Paya Lebar Road, Paya Lebar Square, #06-27, Singapore 409051 ("JobKred", "we", "us").
1.3 By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
2.1 JobKred provides software products and related services, including Lithium, ELLIE, and other products that JobKred may make available from time to time (together, the "Products").
2.2 Access to and use of any Product is not governed by these Terms. It is governed exclusively by the agreement applicable to that Product, which will be one of the following (each a "Service Agreement"):
2.3 If there is any conflict or inconsistency between these Terms and a Service Agreement, the Service Agreement prevails in all respects in relation to the relevant Product, including in relation to fees, service levels, data protection, warranties, liability and dispute resolution. Nothing in these Terms varies, limits or supplements a Service Agreement.
2.4 Descriptions of Products, features, specifications, availability and pricing on the Website are provided for general information only, may change without notice, and do not form part of any Service Agreement unless expressly incorporated into it.
3.1 You must use the Website only for lawful purposes. When accessing the Website you must not:

4.1 Certain areas of the Website allow log-in to a Product. Use of the Product after log-in is governed by the applicable Service Agreement (clause 2). You are responsible for keeping any usernames and passwords secure and must notify us promptly at support@jobkred.com if you believe they have been compromised.
5.1 JobKred and its licensors own all intellectual property rights in the Website and its content, including text, graphics, logos, trade marks (including the JobKred, Lithium and ELLIE names and marks), software, and the design and arrangement of the Website.
5.2 You may view the Website and print or download extracts for your own internal business reference. You must not otherwise reproduce, modify, distribute, sell or exploit any Website content, or use any JobKred trade mark, without our prior written consent.
6.1 The Website may contain links to third-party websites and services. These are provided for convenience only. JobKred does not endorse and is not responsible for third-party websites, their content or their terms, and your use of them is at your own risk.
7.1 Personal data provided through or collected via the Website is handled in accordance with the JobKred Privacy Policy, available at www.jobkred.com/privacy. The Privacy Policy also explains how personal data processed within JobKred Products is handled.
8.1 The Website and its content are provided on an "as is" and "as available" basis for general information. To the maximum extent permitted by law, JobKred excludes all conditions, warranties and representations, express or implied, in relation to the Website, including as to accuracy, completeness, availability and fitness for a particular purpose.
8.2 Nothing in this clause 8 applies to, or limits any warranty or commitment given in, a Service Agreement.
9.1 This clause 9 applies only to use of the Website. Liability arising in connection with a Product is governed exclusively by the applicable Service Agreement.
9.2 To the maximum extent permitted by law, JobKred is not liable for any loss or damage of any kind arising out of or in connection with use of, or inability to use, the Website or reliance on any content on it, whether in contract, tort (including negligence) or otherwise, including any indirect or consequential loss, loss of profit, revenue, business, data or goodwill.
9.3 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud or for death or personal injury caused by negligence.
10.1 You shall indemnify and hold harmless JobKred and its officers, employees and agents from and against all claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms or your unlawful use of the Website.
11.1 We may update, modify, suspend or discontinue any part of the Website at any time. We may revise these Terms from time to time by posting the revised version on this page with an updated "last updated" date. Continued use of the Website after a revision takes effect constitutes acceptance of the revised Terms. Revisions to these Terms do not vary any Service Agreement.
12.1 If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. A failure by JobKred to enforce any provision is not a waiver of it.
12.2 These Terms are governed by the laws of the Republic of Singapore. Disputes arising out of or in connection with use of the Website are subject to the exclusive jurisdiction of the courts of Singapore. Disputes arising under a Service Agreement are resolved in accordance with the dispute resolution provisions of that Service Agreement.
